Custodianship Declaration - Custodian For Minors Studying in Canada (IMM 5646E)

Your completed Custodianship Declaration form (IMM 5646E) will need to be commissioned in order to be accepted by Immigration, Refugees, and Citizenship Canada. Dotted Line Notary can help you commission it.

What is it?

​If your child who is a minor (a child under the age of majority - 18 in Ontario) wants to study in Canada and they aren't a Canadian citizen or a permanent resident, then you must prove your child will have the care and support they need while in Canada. Minor children under the age of 17 must either:

• come to Canada with their parent or guardian OR

• have a custodian in Canada.

A custodian is a responsible adult, who is a Canadian citizen or permanent resident, who will take care of and support the minor child. It is optional to have custodian for minor children 17 years of age or older, but an immigration officer may request one on a case-by-case basis.

How do I appoint a Custodian?

To appoint a Custodian, you must submit to Immigration, Refugees, and Citizenship Canada the following:

• your minor child's completed study permit application

• a completed Custodianship Declaration form

The Custodianship Declaration form consists of two pages:

• The first page needs to be signed by the custodian and notarized in Canada

• The second page needs to be signed by the parents or legal guardians of the minor child and notarized in their home country
